All tobacco products, electronic nicotine delivery systems (ENDS), e-liquids, nicotine pouches, and synthetic nicotine products sold by Sky Smoke & Vape contain nicotine unless explicitly stated otherwise. Nicotine is highly addictive and may be dangerous to your health.

2. Age Restriction

THE SALE OF TOBACCO PRODUCTS, NICOTINE PRODUCTS, OR NICOTINE DISPENSING DEVICES TO PERSONS UNDER THE AGE OF 21 IS AGAINST FLORIDA LAW.

You must be at least 21 years of age to purchase any product from Sky Smoke & Vape. A valid, government-issued photo ID is required for every purchase. No exceptions.

3. Health Warnings & Disclaimers

The products sold by Sky Smoke & Vape have not been evaluated or approved by the U.S. Food and Drug Administration (FDA) as smoking cessation aids. These products are not intended to diagnose, treat, cure, or prevent any disease or condition.

Important health information:

  • Tobacco and nicotine products are addictive and may be harmful to your health.
  • These products are not intended for use by non-smokers or non-users of nicotine.
  • These products are not intended for use by pregnant or breastfeeding women.
  • If you have a heart condition, high blood pressure, diabetes, or are taking medication for depression or asthma, consult your physician before using any nicotine product.

  • E-liquid and vape products contain chemicals including propylene glycol, vegetable glycerin, flavorings, and nicotine. The long-term health effects of inhaling these substances are not fully known.

4. Product Safety

Battery safety: Vaping devices contain lithium-ion batteries. To prevent injury:

  • Use only the charger provided with or recommended for your device.
  • Do not leave devices charging unattended or overnight.
  • Do not carry loose batteries in your pocket with metal objects (keys, coins).
  • Do not use damaged, dented, or wet batteries or devices.
  • Store batteries in a protective case when not in use.
  • Discontinue use immediately if a device becomes excessively hot, emits unusual odors, or shows signs of damage.

Glass products: Glass pipes, water pipes, and accessories are fragile. Inspect all glass products carefully before leaving the store. Sky Smoke & Vape is not responsible for damage that occurs after purchase. Handle all glass products with care.

5. Retailer Disclaimer

Sky Smoke & Vape is a retailer and distributor of products manufactured by third parties. We do not manufacture, formulate, or produce any of the products we sell. While we carefully select the brands and products we carry, we cannot and do not guarantee the safety, efficacy, quality, or accuracy of any product beyond the representations made by the manufacturer.

All products are sold “AS IS.” We make no express or implied warranties regarding any product, including warranties of merchantability or fitness for a particular purpose. The buyer assumes all risk and liability for the use of any product purchased from Sky Smoke & Vape.

7. Florida-Specific Notices

Florida Clean Indoor Air Act (Chapter 386): Florida law restricts smoking and vaping in most enclosed indoor workplaces and public spaces. Retail tobacco shops are exempt from certain provisions. However, customers are responsible for understanding and complying with all applicable smoking and vaping restrictions in their area, including local ordinances in Sarasota County, Manatee County, and Charlotte County.

School zone restrictions: Florida law prohibits persons under 21 from smoking or vaping within 1,000 feet of any public or private elementary, middle, or secondary school between the hours of 6:00 AM and midnight.

Kratom availability: Due to local regulations, kratom products are not available at our Sarasota locations (Swift Rd, Downtown, Beneva Rd, and Clark Rd). Kratom is available at our Bradenton, Palmetto, and Port Charlotte locations.
