Return & Exchange Policy
1. All Sales Are Final
Due to the regulated nature of the products we sell, all sales at Sky Smoke & Vape are final. We do not offer refunds, returns, or exchanges on any tobacco products, nicotine products, vaping devices, e-liquids, accessories, or any other merchandise.
This policy is in effect at all 13 Sky Smoke & Vape locations across Southwest Florida.
2. Why All Sales Are Final
This policy exists for important legal and safety reasons:
- Federal and state law prohibits the resale of returned tobacco and nicotine products. Once a product leaves our store, it cannot be verified as untampered and cannot legally be placed back into inventory for resale.
- Florida Statute § 501.142 exempts products that “cannot be resold” due to law or regulation from standard retail refund requirements. All tobacco, nicotine, and vaping products fall under this exemption.
- Age verification requirements mean that returned products cannot be guaranteed to have remained in the possession of a person of legal age.
- Health and safety concerns prevent us from reselling consumable products (e-liquids, pods, coils, tobacco, nicotine pouches) that have left our control.
3. Defective Product Exception
We stand behind the quality of the products we carry. If you receive a product with a genuine manufacturing defect, we may offer a one-time replacement or store credit at our sole discretion, subject to the following conditions:
- You must return the defective product to the same location where it was purchased.
- You must present your original receipt as proof of purchase.
- The return must be made within 24 hours of the original purchase.
- The product must show clear evidence of a manufacturing defect (not damage from misuse, improper storage, or normal wear and tear).
- A store manager must inspect and approve the defect claim.
This exception does NOT apply to:
- Consumable products (e-liquids, pre-filled pods, coils, tobacco products, nicotine pouches, hookah tobacco)
- Products damaged by misuse, dropping, water exposure, or improper charging
- Products without a receipt or proof of purchase
- Products purchased more than 24 hours prior
- Products purchased at a different Sky Smoke & Vape location
- Glass products (pipes, water pipes, rigs) — these are inspected at the time of sale and are the customer’s responsibility after leaving the store
4. Pricing & Promotions
Prices may vary between locations. We do not offer price matching between Sky Smoke & Vape locations or against competitor pricing. Promotional and sale prices are available for a limited time and are subject to change without notice. No retroactive price adjustments will be made on previous purchases.
5. Tips for a Successful Purchase
To ensure your satisfaction with every purchase:
- Ask questions before buying. Our staff is trained and knowledgeable — we are happy to help you find the right product.
- Inspect all products before leaving the store. Check that devices power on, glass is intact, and packaging is sealed.
- Keep your receipt. Your receipt is required for any defect claims.
- Ask about our loyalty program. Earn 5% cash back on every purchase to use toward future visits.
6. Credit Card Disputes
If you initiate a credit card chargeback or dispute for a legitimate purchase, we reserve the right to provide transaction records and ID verification documentation to your card issuer. Fraudulent chargebacks may result in being barred from future purchases at all Sky Smoke & Vape locations and may be reported to the appropriate authorities.
