1. Acceptance of Terms

Welcome to Sky Smoke & Vape (“Company,” “we,” “us,” or “our”). By accessing our website at sky941.com (“Site”) or entering any of our 13 retail locations across Southwest Florida, you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, please do not use our Site or visit our stores.

We reserve the right to update or modify these Terms at any time without prior notice. Your continued use of the Site or our stores following any changes constitutes your acceptance of the revised Terms. The date of the most recent revision will appear at the top of this page.

2. Age Restriction & Verification

In accordance with Florida Statute Chapter 569 and federal law, you must be at least 21 years of age to purchase tobacco products, nicotine products, or nicotine dispensing devices. This applies to all products sold by Sky Smoke & Vape, including but not limited to: electronic cigarettes, vaporizers, and all vaping devices; e-liquids, vape juice, and nicotine salt products; cigars, cigarillos, and pipe tobacco; hookah and hookah tobacco (shisha); smokeless tobacco and nicotine pouches; glass pipes, water pipes, and smoking accessories; kratom products (available at select locations only); CBD and hemp-derived products; synthetic nicotine products; and detox and related products.

All customers are required to present a valid, government-issued photo ID at the time of purchase. Acceptable forms of identification include a state-issued driver’s license, state ID card, U.S. passport, or military ID. We reserve the right to refuse any sale if valid identification cannot be provided or if there is any doubt regarding the customer’s age.

By entering this Site or clicking “I AM 21+” on our age verification gate, you certify that you are at least 21 years of age and are legally permitted to purchase tobacco and nicotine products in the State of Florida.

3. Product Information & Availability

We make every effort to accurately display product information on our Site and in our stores. However, product availability, pricing, and descriptions may vary by location and are subject to change without notice. We do not guarantee that any specific product will be available at any particular location at any given time.

All products sold by Sky Smoke & Vape are intended for use only by persons of legal purchasing age. Products are sold for their intended legal purposes only, and we are not responsible for any misuse of products after purchase.

4. In-Store Purchases Only

Sky Smoke & Vape operates exclusively as a brick-and-mortar retailer. We do not sell products online. All purchases must be made in person at one of our 13 retail locations. Our Site is informational only and does not process transactions, accept orders, or facilitate online purchases.

5. Pricing & Payment

All prices are listed in U.S. dollars and are subject to applicable Florida state sales tax. Prices may vary between locations. We accept cash, major credit cards, and debit cards. We reserve the right to change prices at any time without notice. Promotional pricing, discounts, and special offers are available while supplies last and may be subject to additional terms.

6. All Sales Final — No Returns or Refunds

Due to the nature of the products we sell and in accordance with Florida Statute § 501.142, all sales of tobacco products, nicotine products, vaping devices, and related accessories are final. We do not offer returns, refunds, or exchanges.

This policy exists because federal and state regulations prohibit the resale of returned tobacco and nicotine products due to health, safety, and age-verification concerns.

Exception — Manufacturing Defects: If a product has a genuine manufacturing defect, you may bring it to the location where it was purchased within 24 hours of purchase with your original receipt. At our sole discretion, we may offer a one-time replacement or store credit. This does not apply to consumable products (e-liquids, pods, coils, tobacco), products damaged by misuse, or products without proof of purchase.

7. Loyalty Program

Sky Smoke & Vape offers a customer loyalty program through our designated loyalty partner. By enrolling, you agree to the collection of your name, phone number, and purchase history for the purpose of accruing and redeeming rewards. Loyalty program benefits, point values, and terms are subject to change at our discretion.

8. Intellectual Property

All content on this Site, including text, graphics, logos, images, and software, is the property of Sky Smoke & Vape or its content suppliers and is protected by United States and international copyright and trademark laws. You may not use such marks without our prior written permission.

9. Prohibited Conduct

When using our Site or visiting our stores, you agree not to: attempt to purchase products if you are under 21 years of age; use a false, fraudulent, or altered ID; purchase products on behalf of any person under 21; engage in disruptive, threatening, or abusive behavior toward staff or customers; shoplift, steal, or attempt to defraud the Company; or use the Site for any unlawful purpose.

10. Disclaimer of Warranties

THE SITE AND ALL PRODUCTS ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

Sky Smoke & Vape is a retailer and distributor, not a manufacturer. We do not provide any assurance regarding the safety, efficacy, or quality of any product beyond what is provided by the manufacturer.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY FLORIDA LAW, SKY SMOKE & VAPE, ITS OWNERS, OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF YOUR USE OF OUR SITE, YOUR PURCHASES, OR YOUR USE OF ANY PRODUCT.

Our total liability for any claim shall not exceed the purchase price of the specific product giving rise to the claim. You assume all risk associated with the use of any product purchased from Sky Smoke & Vape.

12. Indemnification

You agree to indemnify, defend, and hold harmless Sky Smoke & Vape, its parent companies, subsidiaries, affiliates, officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses arising from your violation of these Terms, your use of any product, or your violation of any applicable law.

13. Compliance with Laws

You are solely responsible for compliance with all applicable federal, state, and local laws regarding the possession, use, and consumption of products purchased from Sky Smoke & Vape. This includes the Florida Clean Indoor Air Act (Chapter 386) regarding smoking and vaping in indoor spaces, local ordinances in Sarasota County, Manatee County, and Charlotte County, and school zone restrictions (no smoking or vaping within 1,000 feet of any school between 6:00 AM and midnight for persons under 21).

14. Governing Law & Dispute Resolution

These Terms shall be governed by the laws of the State of Florida. Any legal action shall be brought exclusively in the state or federal courts located in Sarasota County, Florida, and you consent to the personal jurisdiction of such courts.

15. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
